This website is operated by Parkteam AG. By registering with Comwat (comwat.de or comwat.com including all corresponding sub domains and country domains), you accept the following terms of use. If you don't accept those terms of use you can not register with Comwat.

Parketam AG may change the terms of use at any time and without giving reasons. Each member will get an email with the changes of the terms of use two weeks in advance. If the member does not react or disagree with the new terms of use, he accepts the changes – this will be also pointed out in the email.

§1 Validation
The following terms and conditions between the operator and the user are effective without restrictions. Differing terms of users conflicting with these terms and conditions are not significant.

§2 Contract conclusion
The contract between operator and user is concluded with the user's registration with Comwat.

§ 3. Beschreibung des Services bzw. Leistungsumfang

§3 Services
a) The operator provides an internet communications platform where members can contact each other and communicate. A member can log in, invite other friends to his network and search for other members within the platform whose profiles will be stored in a central data base. Members can read the profiles of other members and contact them.
b) with their registration all members agree to use the services of the platform for private issues only. A commercial use of the services is strictly forbidden.

§ 4 Costs
The registration and the services of Comwat are free of charge.

§ 5
a) The operator provides storage space at Comwat for the users' contents, especially links.
b) The user is fully responsible for his contents. The user agrees that his contents don't violate legal requirements or morality. Offensive, abusing, racist, violent, aspersive, annyoing or pornographic contents are strictly forbidden.
c) The operator is authorized to block or to delete contens which offend against the conditions formulated in the terms of use. The user has no right to claim for the insertion of contents, cancellation of blocking or a re-insertion of deleted contents. Additionally Comwat is authorized to ban users from a future use of the Comwat services and/or ask them for damages.
d) The operator stores personal information of the users. Those information are generated from user specifications and their usage of the Comwat services. The user agrees that his personal data will be electronically stored by the operator.
e) The operator stores, uses and analyzes information to provide the best possible functionality of the platform and to offer the users a better service.
f) The user agrees that the data he publishes in his profile can bee seen by other users.

§6 Completion of the contractual relation
The membership can be terminated by the user or by the operator without any reason in written form or by email. There is no cancellation period. If a user cancels his membership all of his data will be deleted. The user doesn't qualify for getting back the content he published at Comwat.

§7 Limitation of liability
a) The operator doesn't assume liability for the accuracy and the content of the information in the users' profile data or the content generated by the users. The operator doesn't assume liability for a possible misuse of information.
b) The operator refuses any liabilities for economic, physical or immaterial damages that may occur when using the communication platform.
c) Despite accurate attendance and support of the system the operator can not guarantee the all-time availability. So there is no claim for using the services.
d) The operator doesn't assume liability for an unauthorized access of the personal user data by other parties (e.g. by an unauthorized access of the data base by "hackers"). The operator also doesn't assume liability when data and information are provided to and misused by third parties.
e) The operator is allowed to stop the services of Comwat with or without any reason at all time.

§8
The operator is not responsible for damage which develops directly, indirectly, coincedanbtally or as a consequence from the use or the users' lacking abilities for the use of Comwat.

§9
a) the members are fully responsible for their published contents
b) the user agrees to indemnify the operator from any kind of sues, damages, casualties or payment requests that may occur with the registration of the user or the use of the Comwat services.
c) the user is not allowed to misuse the services, especially:
- to publish offensive or other non-legal contents, especially pornographic, racist or comparable contents
- to import data into the system containing a computer virus (infected software) or other contents that are not in copyright matters.
- to use the services in any way that negatively affects the availabilty of services for other Comwat users
- to create profiles for cheating or defaming other members
d) offending against these terms of use will lead to the cancellation of the user's membership and/or legal consequences.

§ 10 Involving third parties
The operator may authorize third parties with the supply of the services

§ 11 Salvatori clause
With inefficacy of one of the above conditions the effectiveness of the remaining conditions remains unaffected. The ineffective clause is then replaced by another which comes economically and in your intention of the ineffective clause next. The same applies if at the time of the execution of the contract a auxiliaryneedy gap becomes obvious.

§ 12. 12 Jurisdiction
The use of this website is governed by all applicable laws and regulations of Germany.
